Heard Sri Vishnu Murti Tripathi, learned counsel for the petitioner, Shri Mantosh Singh holding brief of Shri Satyendra Narayan Singh, learned counsel for the private respondents and Sri Deepak Mishra, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. registered as case crime no.775 of 2018 under sections 147, 149, 323, 504, 506, 448, 452, 354 (Ka) 395 IPC, police station Dhoomanganj, district Allahabad.
Learned counsel for the petitioner submits that the matter was referred to the Mediation and Reconciliation Centre of this Court, but private- respondent Nos. 4 and 5 did not appear before the Mediation Centre and now the next date is fixed for 30th of August, 2018.
Shri Mantosh Singh holding brief of Shri Satyendra Narayan Singh, learned counsel for the private respondents states that there is no chances of settlement between the parties.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
