Grant of unconditional leave to defend in Summary Case No. 22 of 2006 by the learned 4th Addl. Chief Judicial Magistrate, Surat is challenged by way of Special Civil Application No. 1403 of 2011.
This Civil Application is preferred with a request to fix early date for final hearing of said Special Civil Application on the ground that the whole object and purpose of Summary Case filed under Order XXXVII CPC otherwise would be frustrated.
On having heard learned advocate for the parties and on having considered the cause, request is acceded to. Civil Application is allowed. Registry is directed to place Special Civil Application No. 1403 of 2011 for final hearing on 12th March 2012.
