By way of this petition, the petitioner has challenged the judgement and award dated 8.1.2007 of Special Labour Court, Ahmedabad, whereby the Labour Court dismissed the Reference. 2. The case of the petitioner is that he was working as conductor. He had failed to issue tickets to six passengers. Charge sheet was served to the petitioner. After holding Departmental Inquiry, the services of the petitioner came to be terminated. The petitioner preferred appeal against the same which was dismissed. Therefore, the petitioner preferred complaint before Conciliation Officer but no settlement was arrived at. The petitioner filed statement of claim before the Labour Court. The respondents filed written statement. After considering the evidence on record, Special Labour Court dismissed the Reference vide order dated 8.1.2007. Hence the petitioner is before this Court.
3. Learned counsel for the petitioner contended that he has worked for more than 10 years. In the case of similarly situated persons, the Labour Court has taken a liberal view. Therefore, a liberal view may be taken by this Court.
4. While considering the case that the petitioner was involved in corruption charges in the inter-State route between Ahmedabad and Indore, in my view, the view taken by the Special Labour Court is just and proper. No interference is called for with the same. In that view of the matter, the petition is dismissed. Rule is discharged. No order as to costs.
