JUDGMENT / ORDER

Ramachandra Menon, J.
This Writ Petition is filed seeking police protection because of the alleged course pursued by respondents 6 to 9, taking the law into their own hands, in spite of the fact that similar attempts made earlier were intercepted by this Court, which resulted in Exhibits P1 and P2 judgments.
2. The sequence of events narrated in the Writ Petition shows that there is some dispute between the petitioner and the party respondents. It is stated that the petitioner purchased a small extent of property near the property of some of the party respondents. It is stated that the 8th respondent had interest over the said property and the petitioner was asked to convey the property to him, which was not acceded to. This made the respondents 6 to 9 to harass the petitioner and assault him. Earlier, in similar circumstances, the petitioner was constrained to approach this Court by filing W.P(C).No.2289 of 2009, which was WP(C).13377/14 2 disposed of by as per Exhibit P1 judgment directing the police to see that law and order situation was maintained and the lives of both parties were not endangered. The learned Single Judge did not interfere with the civil dispute between the parties. Even after Exhibit P1 judgment, the petitioner was constrained to approach this Court again by filing W.P(C).No.34944 of 2010. The statement made by the learned Government Pleader in the said Writ Petition that the real dispute between the parties was for a pathway and that there was no law and order situation, was recorded and the matter was disposed of accordingly, as per Exhibit P2 judgment.

Now, the petitioner contends that similar assault occurred on 18.5.2014 at about 8 p.m while he was riding on a scooter, when the petitioner approached the police for assistance, bringing Exhibits P1 and P2 judgments to their notice. Since there is callous inaction on the part of 5th respondent, to extend necessary help, the petitioner has approached this Court by filing this Writ Petition.
4. The learned Government Pleader, on instructions, submits that there is no threat to the law and order situation as alleged by the petitioner. If at all any offence has been committed by the party respondents, the same will be looked into and appropriate action would be taken after investigation.
WP(C).13377/14 3 The submission of the learned Government Pleader is recorded and the matter is disposed of accordingly.
