Heard Mr. Pawan Kumar Dubey, holding brief of Mr. Ashutosh Tripathi, learned counsel for the applicant as well as learned Additional Government Advocate appearing for the State and perused the record of the case.
By means of this application under section 482 Cr.P.C., the applicant has prayed for expeditious disposal of Criminal Complaint Case No. 489 of 2015, (Vishnu Sharan vs Murti Singh), under section 156 (3) Cr.P.C., pending in the court of Additional Chief Judicial Magistrate-IInd, Mirzapur.
Learned AGA states that no useful purpose would be served in issuing notice to opposite party No. 2 and keeping this application pending before this Court and it may be disposed of at this stage itself.
Considering the limited grievance of the learned counsel for the applicant, learned Additional Chief Judicial Magistrate-IInd, Mirzapur is directed to make an endeavour to decide the aforesaid case, as expeditiously as possible, in accordance with law, after hearing the concerned parties, preferably within a period of eight months from the date of production of a certified copy of the order before the concerned court below, in case the proceedings of the aforesaid case, is not stayed by any court.
With the aforesaid observations/ directions, the present application is finally disposed of.
