Heard Sri Sunil Singh, learned counsel for the petitioner, Sri Prabhash Pandey, learned Brief Holder for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 16.12.2017 registered as case crime no.381 of 2017 under sections 467, 468, 471 I.P.C., police station Chetganj, District Varanasi.
Learned counsel for the petitioners submits that the present FIR has been lodged by the respondent no.4 with the allegation that the certificate of B.Ed. on the basis of which the petitioner got appointment was forged one which was disputed by the petitioner. Some litigation has reached upto this Court. Committee of Management of the said University has also filed some writ petition against the petitioner and the same was dismissed.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
However, the Investigating Officer of this case is directed to conclude the investigation within three weeks from the date of production of a certified copy of this order. In case this order is not placed before the Investigating Officer, the order granting protection shall be discharged.
