Heard learned counsel for the applicants and learned A.G.A.
This application has been filed with prayer to quash the proceedings of criminal case No. 84 of 2008 under sections 307, 324, 323, 504, 506 IPC, P.S. Kotwali Nagar, district Balrampur pending in the court of learned C.J.M. Balrampur.
From the perusal of the record, it appears that in the present case the chargesheet has been submitted in case crime No. 696 of 2007. On the basis of material collected by the I.O. the prima facie offence is made out. Therefore, there is no irregularities or illegality in filing the charge-sheet, the prayer for quashing the above mentioned proceedings as well as charge-sheet is refused.
However, considering the facts and circumstances of the case, it is directed that in case the applicants appear before the court concerned within 30 days from today and apply for bail, the same shall be heard and disposed of.expeditiously if possible on the same day by the courts below.
With this direction, this application is finally disposed of.
