Heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.
The petitioner, by means of the present writ petition, has challenged the suspension order dated 01.07.2020, passed by respondent no.2-District Magistrate, Chandauli.
After some argument, learned counsel for the petitioner is confined his prayer that the respondent no.2-District Magistrate, Chandauli be directed to conclude the disciplinary proceeding pending against the petitioner, expeditiously within a time bound period.
Considering the fact that the petitioner has been suspended by order dated 01.07.2020 passed by the respondent no.2-District Magistrate, Chandauli and charge sheet has been issued against the petitioner on 21.09.2020, copy of which is annexed as Annexure-4 to the writ petition, this Court finds it appropriate in the facts and circumstances of the case to direct the respondent no.2-District Magistrate, Chandauli to conclude the disciplinary proceedings pending against the petitioner expeditiously, preferably within a period of two months from the date of production of a copy of this order before him.
It is needless to say that the petitioner shall cooperate in the enquiry. In case, the petitioner does not cooperate in the enquiry, the disciplinary proceeding may be concluded ex-
parte.
In view of the fact that due to the pandemic of COVID-19, the certified copy is not being issued by the High Court, therefore, the order downloaded from the website duly certified by learned counsel for the petitioner may be treated as true copy of the order and the Authority may not refuse to comply the order on the ground of non filing of certified copy of the order.
