JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 2818 of 2004 Petitioner :- Vishnu Narain Nayak Respondent :- State Of U.P. And Others Counsel for Petitioner :- S.P. Singh,Jai Singh Parihar,Vinod Sinha Counsel for Respondent :- C.S.C.,Praveen Kumar
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
“(i) a writ order or direction in the nature of Certoirari quashing the advertisement no. 1/19992000, Orders dated 16.8.2003 and 22.9.2003 (Annexure.2 and 3 ) passed by respondent no.3 and panel dated 31.3.2003 after summoning the same from the office of respondent no, 2 and 3.
(ii) A writ order or direction in the nature of mandamus directing the respondent not to give the effect to the impugned penal dated 31.3.2003 and orders dated 16.8.2003 and 22.9.2003 passed by the respondent no.3.
(iii) A writ order or direction in the nature of Mandamus directing the respondents not to interfere in the function of the petitioner as Principal in Gandhi Vidyalaya Inter College Mau Ranipur, Jhansi.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 14.9.2018 AK
