JUDGMENT / ORDER

Petitioner is the 5th accused in Crime No.20 of 2014 of the Chavakkad Police Station for the offences punishable under Sections 452, 153A, 120B, 427, 143, 147, 148 read with Section 149 of the Indian Penal Code, apprehends arrest and has filed the application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on 01.01.2014 at about 1.30 a.m., the petitioner and others trespassed into the compound of a mosque and destroyed articles including tiles of the mosque causing loss, in their attempt to cause communal disharmony.
3. Learned counsel submits that the allegations are not true. It is submitted that motive originally stated in the F.I.R is different. It is also submitted that the petitioner was subsequently implicated falsely in the case.

4. I have gone through the CD file. In the nature of the allegations made against the petitioner and investigation required to be done, request for pre-arrest bail cannot be allowed.
It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early a possible.
The application is dismissed.
