Heard learned counsel for the petitioners and Sri Aasif Razzaque Khan learned counsel appearing for the opposite party nos. 1 and 2.
Sri Aasif Razzaque Khan, learned counsel for the opposite party nos. 1 and 2 at the very outset has stated that there is no interference by the Bar Council of U.P. in the matter of ongoing election of the Central Bar Association, Lucknow.
In view of the statement so made and without delving anything on merit, it is left open to the petitioners to agitate the grievance relating to the election, if any, before the competent court/authority and the present writ petition for the dispute raised herein may not be maintainable under Article 226 of the Constitution of India. Any order or direction issued by the U.P. Bar Counsel placed on record may thus be treated as inoperative.
Declining to entertain the present writ petition on the grounds urged before this Court, the petitioners are at liberty to avail the remedy under Section 25 of the Societies Registration Act, 1860 or a civil suit.
The writ petition is accordingly dismissed.
