JUDGMENT / ORDER

Petition under Section 438 Cr.P.C.
2. According to the petitioner, he is apprehending arrest in connection with Crime No.1613 of 2013 of Valappad Police Station.
3. The learned Public Prosecutor pointed out that the same is pending as C.P.No.55 of 2014 before the court below, awaiting committal. It has been reported that non bailable warrant is pending against the petitioner.
4. This is not a fit case wherein anticipatory bail can be granted. It is for the petitioner to surrender before the court below and move for bail. The learned counsel for the petitioner has argued that the other accused were granted bail when they had surrendered. Of course, it is open to the B.A. No.7420 of 2014 -: 2 :-
petitioner to point out the said aspect to the court below. In such a case, the court below shall pass appropriate orders.
The bail application is disposed of accordingly.
