This writ petition is directed against an order dated 10.8.2020, passed by District Probation Officer, Hathras, which records that petitioner does not possess requisite qualification and therefore he has been repatriated to the service provider i.e. respondent no.5. Aggrieved by this order, petitioner is before this Court.
Petitioner's status admittedly is that of an outsourced Computer Operator, whose service has been provided by respondent no.5. There is no privity of contract between the petitioner and the State. In such circumstances grievance of petitioner can at best be against respondent no.5, which is a private body. No relief in such circumstances can be claimed by petitioner against the State or its authorities. In respect of any grievance against the employer remedy of the petitioner would be to approach the industrial forum constituted under the U.P. Industrial Disputes Act, 1947 and writ petition would not be the appropriate remedy, at the first instance.
Writ petition lacks merit and is accordingly dismissed.
