The submission of learned counsel for the petitioner is that he applied for the sanction of 5 KW electric connection for running an expeller on 09.05.2018 after depositing a sum of Rs. 10,000/-. The said electricity connection was sanctioned but as the meter was not available, the petitioner was permitted to use electricity without meter.
Subsequently, on the basis of some inspection, a case of theft of electricity has been registered and the petitioner has been served with the impugned recovery citation dated 28.05.2019 for a sum of Rs. 5,33,704/-.
Sri Baleshwar Chaturvedi informs that the petitioner had subsequently applied for increasing the load to 18 KW and that without the sanction of the said additional load, he was running the expeller which clearly shows that he was using electricity unauthorizedly over and above the sanctioned load.
Sri Baleshwar Chaturvedi may seek instructions and produce the checking report to indicate if the petitioner was found using more than 5 KW of load.
He may seek instructions and produce the necessary documents in this regard by next Thursday.
Put up on Thursday i.e. 01.08.2019 in the additional list.
In the meantime, the respondents will not take any coercive steps against the petitioner.
