Heard learned advocate Mr.Rakesh Gupta with Mr.Uday Joshi, learned advocates for Messrs Trivedi & Gupta for the petitioners; and Mr.Anshin H. Desai, learned advocate for the respondents. The learned advocate for the petitioners relied upon a decision of the Hon'ble the Apex Court in the matter of Pune Municipal Corporation Vs. State of Maharashtra & others, reported in (2007) 5 SCC
211. As against that the learned advocate for the respondents, Mr.Desai relied upon a decision dated 20th August 2008, of the Punjab & Haryana High Court (Coram: Hon'ble Mr.Justice Hemant Gupta & Hon'ble Mr.Justice Rajesh Bindal) in the matter of M/s M/s Alfa International, Jalandhar Vs. Union of India and others, in Writ Petition No.2069 of 2008. The learned advocate Mr.Gupta for the petitioners submitted that Special Leave Petition is already admitted against the aforesaid judgement of Punjab & Haryana High Court being Special Leave to Appeal (Civil) No.27711 of 2008 (from the judgement and order dated 20.08.08 in CWP No.2069 of 2008 by the High Court of Punjab & Haryana at Chandigarh) on 13th April 2009, where the Hon'ble the Apex Court passed the following order:
Upon hearing the counsel leave is granted. Hearing is expedited.
2. In view of that the matter requires consideration. Rule. Ad interim relief granted earlier to continue till disposal of the matter.
It will be open for the learned advocates for the parties to move an appropriate application at an appropriate time for early hearing of the matter.
