The present appeal is preferred against the ex-parte order dated 2.5.2012 passed by the City Civil Court No.20, Ahmedabad below notice of motion application Exhs.6 and 7 in Civil Miscellaneous Application No.427 of 2012, wherein the following order was passed:
"The Show Cause Notice to be issued R.O.20.06.2012 till then the opponent is directed to maintain status quo as per today in respect of land and superstructure construction of land bearing Survey No.658/1/2/2 and City Survey No.186-B admeasuring 2657.85 sq.mtrs. Situated at Dehgam, Tal.Dehgam, Dist.Gandhinagar."
Learned advocate for the appellant submits that the next date of hearing of the said application is fixed on 20.6.2012.
In view of the above, the learned City Civil Court No.20, Ahmedabad is directed to dispose of the application for injunction in Civil Miscellaneous Application No.427 of 2012 within twenty days from the date of receipt of the order, without fail, on its own merits and in accordance with law without being influenced by the order passed by this Court today or the initial order passed by the Civil Court on 2.5.2012 below injunction application.
With the above direction, this appeal is disposed of. In view of the order passed in the Appeal, Civil Application does not survive and hence disposed of accordingly. Direct service is permitted.
