Heard learned counsel for the appellant and perused the judgment of the Tribunal.
According to the learned counsel for the appellant, the claimant has sustained serious injuries on account of an accident, which took place on 25.4.2015.
Learned counsel for the appellant has submitted that on account of serious injuries, the appellant was admitted in a hospital and was remained in the hospital between 26.4.2015 to 2.5.2015 and again from 4.5.2015 to 18.5.2015.
Learned counsel for the appellant submits that the claimant has produced all the bills which were issued by the hospital as well as the medical bills and claimed compensation of Rs. 20,00,000/-.
Learned counsel for the appellant has further submitted that the Tribunal while deciding the claim petition, recorded a categorical finding that the Insurance Company failed to adduce any material to disbelieve the claim of the claimant and medical bills even then compensation of only Rs. 16200/- was awarded.
Having heard learned counsel for the appellant and after going through the finding recorded by the Tribunal in the impugned order, it is clear that the Tribunal has recorded the finding of fact against the Insurance Company which is quoted herein below:-
"26. प्रललेखखीय ससाक्ष्य मम ससाकखी दसारसा दररटनसा मम आयखी चचोटटों कले सम्बन्ध मम डसाक्टर ककी कचोई आहत आख्यसा पतसावलखी पर दसाखखल नहहीं ककी गयखी हहै। पतसावलखी पर कसागज ससख्यसा 40-ग/10 जय हहॉससपटल एवस ररसचर सलेन्टर मम ददनसासक 26.04.2015 सले ददनसासक 02.05.2015 तक हहए इलसाज कले सम्बन्ध मम दबल ससख्यसा 8960 उक्त असपतसाल कसा दसाखखल दकयसा गयसा हहै परन्तद असपतसाल मम भतर्ती रहनले कले सम्बन्ध मम कचोई दडसचसाजर समरखी दसाखखल नहहीं ककी गयखी हहै, परन्तद बखीमसा कम्पनखी दसारसा उक्त दबल कले अशदद्ध हचोनले कसा कचोई प्रमसाण प्रसतदत नहहीं दकयसा गयसा हहै। शलेष दबल वसाउचर जचो प्रसतदत दकयले गयले हह वह डसाक्टर दसारसा ददयले गयले दप्रसक्रप्शन सले समखररत नहहीं हहै अततः दवश्वसास दकयले जसानले यचोग्य नहहीं हह तरसा उक्त दबल सले उसकसा इलसाज मम 8,200/- रुपयले कसा खचर हचोनसा प्रमसादणत हचोतसा हहै।
27. ओमवतखी नखसरग हचोम मम ददनसासक 04.05.2015 सले ददनसासक 18.05.2015 कले ददौरसान हहए इलसाज कले सम्बन्ध मम जचो रसखीदम प्रसतदत ककी गयखी हह वह दबल वसाउचर ककी शलेणखी मम नहहीं आतले हह तरसा उक्त इलसाज कले सम्बन्ध मम भखी कचोई दडसचसाजर समरखी दसाखखल न दकयले जसानले कले कसारण उक्त रसखीदम दवश्वसास दकयले जसानले यचोग्य नहहीं हहै।
28. यसाचखी दसारसा पतसावलखी पर दवकलसासगतसा प्रमसाणपत कसागज ससख्यसा 46-ग/1 प्रसतदत दकयसा गयसा हहै परन्तद दवकलसासगतसा प्रमसाणपत कचो जसारखी दकयले जसानले वसालले दचदकत्सक कचो परखीदकत करसाकर खसद्ध नहहीं दकयसा गयसा हहै तरसा उक्त दवकलसासगतसा प्रमसाणपत मम यह उदल्लिखखत हहै दक उक्त दवकलसागसतसा प्रमसाणपत कदतपपूदतर एवस न्यसायसालय कले खलए मसान्य नहहीं हहै तरसा उक्त दवकलसासगतसा इलसाज करनले वसालले दचदकत्सक दसारसा जसारखी नहहीं दकयसा गयसा हहै।"
The Tribunal, on the other hand, has recorded the finding in respect of the claim of the appellant that on account of injuries which the claimant sustained 50% disability is acceptable on the ground that the disability certificate is issued on 30.3.2016, whereas, the accident took place on 25.4.2015 and, therefore, there is long gap in issuing the disability certificate, which is relied by the claimant.
In view of the aforesaid, contradictory findings recorded by the Tribunal, the matter is remitted to the Tribunal for consideration the issues afresh and to decide by a reasoned order.
The decision be taken by the learned Tribunal, expeditiously and preferably within a period of four months from the date of production of the certified copy of this order.
The Appeal is, accordingly, disposed of.
