A supplementary affidavit has been filed mentioning that according to the record, no objection under Section 47 CPC, nor under any other provision of law has been filed or is pending.
The prayer made in the instant petition is for issuing direction to the first respondent to decide Execution Case No.6 of 2016 which has been filed by the petitioners for execution of the decree passed in Original Suit No.242 of 1984 expeditiously within a time specified by this Court.
Having regard to the fact that the decree, which is under execution, was passed in a suit instituted in 1984 and also having regard to the stand taken by learned counsel for the petitioners that no objection under Section 47 CPC, nor under any other provision of law is pending, the executing court is directed to proceed with the execution of the decree with a sense of expedition, without granting unnecessary adjournments.
The petition stands disposed of accordingly.
