1. Heard Sri R.K. Ojha, learned Senior Advocate, assisted by Sri P.K. Mishra, learned counsel for petitioner and Sri P.K. Singhal, Advocate for respondent-Bank.
2. Writ petition is directed against order of suspension dated 02.04.2018 passed by Chairman, Prathama Bank in the capacity of disciplinary authority in a pending inquiry.
3. Learned Senior Advocate appearing for petitioner contended that reason on which petitioner has been suspended is clearly non est inasmuch as there was no fault on the part of petitioner and suspension is patently arbitrary.
4. The argument basically dwells in the arena of defence which is available to petitioner when departmental inquiry proceeds and it is not to be examined at this stage. It is not the case of petitioner that impugned order of suspension has been passed by incompetent authority or contrary to statutory provision or there is any allegation of mala fide.
5. In these facts and circumstances, we do not find any justification to interfere with impugned order of suspension at this stage.
6. Dismissed.
