Heard Sri Dharmendra Pratap Singh for the petitioner and Sri Brijesh Ojha for respondents-2 and 3.
This writ petition has been filed for mandamus directing the respondents to correct the parentage of the petitioner in the selection list and issue appointment letter to the petitioner.
It has been stated that in pursuance of advertisement, the petitioner appeared for selection of Safai Karmi on contract basis. However, in the Select List, parentage of the petitioner has been incorrectly noted, due to which, appointment letter has not been issued to the petitioner.
The petitioner has moved an application in this respect before the Nagar Ayukt, in which, inquiry has been conducted and inquiry report has also been submitted and the clerical error in the Select List has been found. The petitioner was required to submit an affidavit. The petitioner has submitted his affidavit also.
The writ petition is disposed of directing the Nagar Ayukt to pass appropriate order on the application of the petitioner, in the light of inquiry report, as well as examining the other documents of the petitioner, within six weeks from the date of producing a certified copy of this order before him. In case there was clerical error in the Select List, in respect of parentage of the petitioner, then he shall proceed to issue appointment letter, in accordance with law.
