Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the impugned charge-sheet dated 25.04.2018, upon which cognizance has been taken in Case No.1503/2018-State Vs. Kamal Agarwal and others, arising out of Case Crime No.547 of 2017, under Sections 406, 452, 323, 504, 506 I.P.C, Police Station Aonla, District Bareilly pending in the Court of Judicial Magistrate-I, Aonla, Bareilly.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within a period of three weeks and the trial court shall decide the same within a period of one month from the date of production of a certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
