JUDGMENT / ORDER

Petition filed under Section 438 Cr.P.C. 2. Petitioner is the second accused in Crime No.207/14 of Mankara Police Station registered for the offences under Section 304-B IPC.
3. Petitioner is the mother in law of deceased Bindu who committed suicide on 14.3.2014. The first accused is the husband of the deceased. The allegation is that demanding dowry they had subjected her to cruelty, which made her commit suicide. The submission of the learned counsel for the petitioner is that the allegations are false, which is evident from the suicide note.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. The criminal law was set in motion by a relative of the deceased. A copy of the suicide note of Bindu has been produced by the petitioner. In it, the deceased has paid complements to the petitioner as well as the first accused. There is no whisper against any of her relatives of the deceased. Under these circumstances, I am B.A.No.2571 OF 2014 :: 2 ::
inclined to grant the prayer of the petitioner.
In the result, this Bail Application is allowed and
1) the petitioner shall be released on bail on her executing a bond for Rs.25,000/- with two solvent sureties each for the like sum if she is arrested by the Police in connection with this case.
2) she shall appear before the Investigating Officer for interrogation if they are so required by him in writing.
3) she shall not destroy or tamper with evidence.
4) this order is not applicable if the petitioner chooses to surrender before the Magistrate concerned and in such case the learned Magistrate may take appropriate action in accordance with the law.
