JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) The applicant-convict is at present on furlough leave and he has to surrender on 24.02.2012.
The applicant by this application has prayed that he be enlarged on temporary bail on the ground of his sickness. He has also referred to the medical certificates which demonstrate that the Doctor has adviced to take opinion from a heart consultant.
At this stage, the learned advocate for the applicant seeks permission to withdraw this application with a liberty that he may be permitted to avail medicines in jail as per the prescription of the Doctor.
We do not think that as per rule any permission is required and we are sure that the jail authorities are providing medicines and convicts are also permitted to have their own medicines.
Application disposed of accordingly.
