Learned counsel for the applicant and learned AGA for the State.
The prayer sought is to settle the order dated 13.11.2018 and 12.12.2018 by which opportunity of cross examination of PW-6 was closed by learned trial Judge. Submitted by learned counsel that on 13.11.2018 when PW-6, who is I.O. of the case. Learned counsel for the applicant has sent an application seeking adjournment in the matter on account of his bad health. The said application was turned down by learned trial judge. On the ground that this is delaying tactics adopted by the applicant.
Submitted by the learned counsel for the applicant that the applicant is languishing in jail since 2016 and in the interest of justice PW-6 may be summoned once again the applicant has given a solemnly undertaking on a next date he would be cross examination.
Submission made above by the learned counsel for the applicant appears to be quite reasonable, let PW-6 may be summoned on or before 20.02.2019 in the process of cross examination and coming he would given Rs. 2500/- as an expenses by the applicant and he would be cross examined would b afforded by the learned counsel for the applicant.
With this observation the present application is disposed of.
