Case diary has been submitted by learned A.G.A. today in the Court, is taken on record.
Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Virendra who is involved in Case Crime No. 249/2017, under Sections 363, 147, 302, 201 I.P.C., Police Station- Sasni Gate, District Aligarh.
As per prosecution version, 20.05.2017 at about 11:00 a.m., Krish Sharma (Deceased) aged about six years son of Smt. Rekha Sharma (Informant) absconded from his residence. Later on 24.05.2017, dead-body of deceased was recovered.
It is contended by learned counsel for the applicant that there is no any criminal antecedent against applicant. The role of applicant is similar to that of co-accused Smt. Maya and Smt. Anita, who have been enlarged on bail by this Court vide orders dated 29.01.2018 & 12.02.2018, passed in Criminal Misc. Bail Application Nos. 2909/2018 & 5095/2018 respectively, copies of which produced for perusal. The applicant has been made accused on the basis of suspicion.
Learned A.G.A. has opposed the prayer for bail and contended that on the door of applicant, blood was found.
Applicant has been made accused on the basis of suspicion by informant Smt. Rekha Sharma after about 2½ month. In the statement of Bharat Singh under Section 161 Cr.P.C., the name of applicant and other accused person came into light. Although informant was known to Bharat Singh but applicant is not named in F.I.R. The role of applicant is similar to that of co-accused Smt. Maya and Smt. Anita.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Virendra be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
Accordingly bail application is allowed. Order Date :- 28.2.2018 Sharad/-
