Heard learned counsel for the petitioner and learned Standing Counsel for the respondents-State.
This petition for writ is preferred to have a direction for respondent-State to make inquiry through competent authority of police or through competent authority of revenue department and further to issue a direction against respondents to take necessary action against respondent no.6 and also to lodge criminal proceedings against him.
While relying upon document annexure 3, it is submitted by the petitioner that even as per the Lekhpal concerned the nature of land was changed by respondent no.6 by fraud.
We do not find any just reason to interfere in the matter.
From the perusal of the facts stated in the petitioner for writ and the documents annexed thereto, it is apparent that as per the petitioner, nature of land has been changed and that is adversely effecting his rights. The cause sought to be agitated by the petitioner essentially pertains to the change of the nature of land and for that as per him the Lekhpal is responsible. We are of considered opinion that no direction to have inquiry in matter can be given by this Court at this stage. At the first, the petitioner is supposed to establish that nature of the land concerned was changed illegally.
In view of whatever stated above, the writ petition is dismissed.
