Heard learned counsel for the petitioner and Sri Pranjal Mehrotra for the respondent bank.
On an earlier occasion and on a writ petition preferred by the petitioner, the Court disposed of the same on 2 November 2018 permitting the petitioner to liquidate the outstanding amounts in instalments. According to the learned counsel, although instalments were deposited those have not been given credit to by the respondent bank and a fresh citation has been issued. This contention is disputed by Sri Mehrotra, learned counsel who appears for the respondent bank and submits that the terms as provided in the order of the Court were not complied with. In any case and since the quantum of the amount claimed is itself questioned, no occasion arises for this Court to entertain this writ petition which shall consequently stand dismissed. This order however shall not preclude the petitioner from initiating appropriate proceedings in accordance with law.
