Heard learned counsel for the applicant and learned A.G.A. for the State.
By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Chief Judicial Magistrate, Court No.1, Kanpur Dehat to consider and decide the Misc. Case No. 305 of 2019 (Ritesh Kumar Vs. Shivakant), under Sections 340 Cr.P.c., PS Chaubepur, District Kanpur Nagar which is filed in Complaint Case No. 189 of 2018 (Shivakant @ Babbul Vs. Virendra Tiwari and others), under Sections 323, 506, 452 I.P.C., PS Chaubepur, District Kanpur Nagar.
It is submitted by learned counsel for the applicant that the aforesaid case is pending since 2019 and thus a suitable direction may be issued to the concerned Court to decide the same within specific time.
No useful purpose would be served in keeping the application pending, which is finally disposed of with a direction to learned Additional Chief Judicial Magistrate, Court No.1, Kanpur Dehat to consider and decide the Misc. Case No. 305 of 2019 (Ritesh Kumar Vs. Shivakant), under Sections 340 Cr.P.c., PS Chaubepur, District Kanpur Nagar which is filed in Complaint Case No. 189 of 2018 (Shivakant @ Babbul Vs. Virendra Tiwari and others), under Sections 323, 506, 452 I.P.C., PS Chaubepur, District Kanpur Nagar, expeditiously, in accordance with law, without granting unnecessary adjournment to either of the party, provided there is no legal impediment.
