Heard learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1, 2 & 4.
The petitioner has preferred the present writ petition with the following prayer:-
"I Issue a writ, order or direction in the nature of mandamus commanding the respondent No.1 to grant and pay the all post retrial dues including pension along with interest thereon to the petitioner in accordance with law."
Facts in brief as contained in the writ petition are that the petitioner was appointed on the post of clerk in the institution in question namely Ram Achal Singh Purva Madhyamik Vidyalay Bahadurpur, Sarai Inayat, Allahabad on 10.07.1977. The approval was also duly granted to the petitioner by District Basic Education Officer, Allahabad on 26.6.1985.
It is argued that pursuant to the appointment, the petitioner worked regularly and superannuated after attaining the age of superannuation, i.e., on 31.10.2017. It is argued that the petitioner is entitled for all retrial dues including the pension but the same has not been paid to him. It is argued that in this regard time and again, various representations were made by the petitioner but no action has been taken on the same.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally permitting the petitioner to submit fresh representation ventilating all his grievances along with self attested computer generated copy of this order downloaded from the official website of High Court Allahabad before respondent No.2/District Basic Education Officer, Prayagraj within a period of three weeks from today. If such a representation is filed within stipulated period as mentioned above, the respondent No.2 shall pass appropriate orders on the same in accordance with law expeditiously and preferably within a period of three months from the date of submission of representation before him.
