Sri B.B. Jauhari, learned counsel has appeared on instructions of the opposite party. It is not disputed that in terms of the communication dated 7 October 2016, the applicant was liable to pay Rs.9,53,266/-. This amount was inclusive of interest upto 25 October 2016. Learned counsel for the applicant does not dispute that the demand notice required him to pay interest for the future period and after 25 October 2016 till the date of actual deposit. Learned counsel for the applicant admits that the only sum paid was the principal amount indicated in the communication of 7 October 2016 which was admittedly inclusive of interest only upto 25 October 2016. Additionally, the Court notes that this payment also was made only on 27 November 2017, although the order of the writ Court had been passed on 2 December 2016.
In view of the above, this Court finds no ground to continue these proceedings in contempt. If in case the applicant pays the entire amounts still outstanding and as claimed due and payable by the authority, Sri Jauhari submits that the authority shall hand over the possession of the flat.
The petition stands disposed of.
