Heard leaned counsel for the petitioner, Sri H.P. Srivastava learned counsel who has put in appearance on behalf of the opposite party nos. 1, 3, 4 and 5 and Ms. Shreya Chowdhary holding brief of Sri Rakesh Kumar Chaudhary, learned counsel who has put in appearance on behalf of the opposite party no. 2.
By means of this writ petition, the petitioner has prayed for a writ or direction in the nature of mandamus commanding the opposite parties to nominate the primary Vidyalaya, Junior High School, ANM Centre as an electoral/polling booth for village Kasba Tehsil and district Sultanpur instead of Van Vibhag Panchopeeran for the panchayat election scheduled to be held on 19.4.2021.
The exercise of deciding a particular centre to be a polling booth lies within the domain of the State Election Commission and its authorities. This Court for such a purpose may not enter into any such dispute particularly when there are no statutory or standing guidelines of which the violation is alleged.
The writ petition being bereft of any merit is hereby dismissed.
