Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that showing the recovery of 130 gm diazapam powder the applicant was falsely implicated. There is no criminal history prior to this case and after that he was challanned under the Gangster Act in which he has been released on bail. There is no compliance of N.D.P.S. Act. He further contended that the applicant will not misuse the liberty of bail and will not indugle into such activity, if he is released on bail. However, the applicant is in jail since 29.4.2010.
In view of the above, without expressing opinion on merit, let the applicant Virendra alais Pintoo Kamal be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No.258/2010 under Section 21/22 N.D.P.S. Act, PS G.R.P. District Kanpur Nagar.
