Heard Sri O.P. Srivastava for the petitioner, Sri Alok Sinha for the State and Dr. Ravi Kumar Mishra for the University.
The petitioner institution applied for issuance of no objection certificate, before the State Government for running B.A. courses, where B.Ed course is already being run. The petitioner has applied for 'no objection certificate' but the State Government raised certain objections on 12.5.2009. According to the petitioner he submitted compliance report. The University has also raised some objections, which according to the petitioner, have been complied with. The Commissioner, Allahabad Division, Allahabad appears to have also raised some objection vide letter dated 20.11.2009, which was received by the petitioner on 3.12.2009. The petitioner says that these objections have also been removed but the matter is still pending before the State Government and no final decision has yet been taken.
Learned counsel for the petitioner submitted that the State Government be directed to take an early decision in the matter after considering the compliance report and reply submitted by the petitioner to the State Government.
Learned counsel for the respondents has no objection.
We, therefore, finally dispose of this petition with the direction that the pending matter regarding grant of 'no objection certificate' with respect to petitioner institution be considered and decided in accordance with law after taking into consideration the reply and compliance report submitted by the petitioner expeditiously; say within a maximum period of three weeks from the date of receipt of the certified copy of this order.
Subject to aforesaid direction, the petition is disposed of finally.
