Heard learned counsel for the petitioner, Sri Rakesh Kumar for the University and the learned Standing Counsel.
This petition impugns an order dated 20 August 2018 in terms of which the claim of the petitioner for compassionate appointment has been negated.
The University has taken the position that a grandson does not come within the definition of dependants as provided in the statute. The relevant statute which was placed before the Court defines a dependant to be a wife, husband, son, unmarried daughter and widowed daughter. Undisputedly, therefore, a grandson is not covered within the definition of dependant.
In view of the above the Court finds no ground to interfere with the order impugned.
The submission of the learned counsel based on various communications and Government Orders cannot come to his assistance since undisputedly appointment in the University is to necessarily be viewed in light of the relevant provisions made in the statute.
The petition is dismissed.
