Heard Ms. Fatima Khatoon, learned counsel for the revisionist-applicant and learned AGA for the State.
This recall application has been moved for recalling of the order dated 29.4.2019, whereby the non-bailable warrant has been issued against the revisionist.
From the perusal of the order dated 29.4.2019, it transpires that Sri Rishabh Srivastava, Advocate holding brief of Sri H.N. Singh, learned counsel for the revisionist and learned AGA for the State were present on the previous date and this Court had issued the non-bailable warrant against the accused-revisionist as he was not present in person before this Court in pursuance of order dated 5.1.2019.
Today, the accused-revisionist Virendra Kumar is present before this Court.
Learned counsel for the revisionist has stated that he is ready for argument. On perusal of record, it appears that the lower court is still not been received. Non-bailable warrant issued in compliance of the order dated 29.4.2019 has not been complied with. Hence, non-bailable warrant dated 29.4.2019 is hereby recalled.
Accordingly, the application allowed.
