1. Heard learned counsel for the petitioner as well as learned Additional Government Advocate and perused the record.
2. By means of this petition preferred under Section 482 Cr.P.C. the petitioner has prayed for quashing the impugned chargesheet no. 229/2018, dated 22-10-2018, arising out of case crime no. 0302 of 2018, under section 352 of I.P.C. and Section 3(1)(d) of SC/ST Act, Police Station-Kampil, District-Fatehgarh, submitted before learned Special Judge, SC/ST Act,Farukhabad.
3. Learned counsel for the petitioner submits that he would like to file an application for discharge under the provisions of Cr.P.C., to which learned counsel for the State, does not dispute.
4. Accordingly, the petitioner is granted liberty to file an application in conformity with the provisions of Cr.P.C., within a period of two weeks from today. After the said application is filed, learned trial Court is directed to dispose of the same within a period of six weeks thereafter. The petitioner is also granted liberty to appear through his counsel.
5. Till disposal of discharge application or for a period of two months, whichever is earlier, no coercive steps shall be taken against him.
6. With the aforesaid observations / directions, the petition stands disposed of.
