1. Sri Devesh Kumar, learned counsel for the applicant after arguing at length, taking this court through certain vouchers on which some persons have signed as amount of dues of food items taken away by police personnel from Taste King, with a view to circumvent payment of dues, present FIR has been lodged. It is further submitted that CCTV footage has already been submitted in a pen-drive to the concerned Sub-Inspector, police station - Nadesar, district Varanasi, but yet it has not been included and made part of the charge sheet.
2. This be a matter of evidence. Therefore, applicants are free to adduce it, at ppropriate stage in trial. Therefore, at this stage, counsel prays for withdrawal of this application, as he proposes to advice his clients to move a discharge application before the court concerned.
3. In above terms, application is dismissed as withdrawn.
