Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record.
By means of this application, the applicant, who is involved in Case Crime No.146 of 2019, under Sections 498-A and 304-B I.P.C. and 3/4 D. P. Act, P.S. Sakeet, District-Etah, is seeking enlargement on bail during the trial.
F.I.R. of the incident was lodged by the complainant against the accused persons and it was alleged in the F.I.R. that daughter of the complainant was done to death in connection with additional demand of dowry by the accused persons on 21.08.2019. The deceased was married with the present applicant on 12.05.2018.
Learned counsel for the applicant submitted that the applicant is quite innocent and has been falsely implicated in the present case.
He further submitted that cause of death could not be ascertained and viscera was preserved. It is next submitted that nine witnesses of fact and formal have been examined. They have not supported the prosecution version and doctor and Investigating Officer have also been examined.
Learned A.G.A. vehemently opposed the prayer for bail of the applicant and submitted that the death of the deceased was unnatural. In the chemical examination it was found that the deceased had died due to consumption of Aluminum Phasphate. This fact has been observed in the statement of the doctor during trial.
Considering the facts and circumstances of the case the Court does not find it fit case for bail as the trial is about to conclude.
The application for bail is, hereby, rejected without expressing any opinion on the merit of the case.
However, trial court is directed to conclude the trial within two months positively.
