Heard Sri Nikhil Chaturvedi, learned counsel for the petitioner, learned Standing Counsel for the State respondents and Sri Dinesh Rai holding brief of Sri Bhupendra Kumar Yadav, learned counsel appearing for respondent No.2.
The present petition seeks to challenge the order dated 18.10.2021 passed by the respondent No.2 in terms of which the petitioner has been placed under suspension pending departmental inquiry.
Learned counsel appearing for respondent No.2 submits that as per instructions received by him, a charge-sheet dated 02.12.2021 has already been served upon the petitioner. He further states that in case the petitioner participates in the inquiry and cooperates with the proceedings, an endeavour would be made to conclude the departmental proceedings expeditiously.
Counsel for the petitioner has not been able to point out any material error or illegality in the suspension order which may warrant interference. He states that the petitioner has already submitted his reply to the charge-sheet and that the departmental proceedings may be directed to be concluded within a reasonable time period.
Having regard to the aforesaid and without expressing any view on the merits of the case, it is provided that in case the petitioner participates in the departmental inquiry and cooperates with the proceedings, the respondent authorities shall endeavour to conclude the proceedings expeditiously and preferably within a period of 3 months from the date of presentation of certified copy of this order.
With the aforesaid observations, the writ petition stands disposed of.
