JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict himself praying for the extension of temporary bail granted on 18.05.2012, whereby, he was ordered to be released on temporary bail for a period of 30 days.
In support of the present application, the convict has produced certain vouchers alongwith a bill for purchasing cement. Besides what is produced is an understanding with one Haribhai Gangjibhai Sakhaiya, wherein, it is stated that he has agreed to carry out construction of the house of the convict by charging Rs.90,000/- towards labour. It is stated that Rs.30,000/- is paid in cash, next instalment will be paid at slab level and the remaining Rs.30,000/- will be paid on completion of the work.
Sometimes, over-enthusiasm shown by the parties so as to convince the Court on the point of genuineness creates suspicion. Normally, no such understanding is entered into for such labour work. Party is supporting the application by producing writing of understanding (Samjuti), which makes things suspicious. The Court is not convinced of the ground for which extension is prayed for. Hence, the application is rejected.
