This criminal appeal has been filed against the judgment and order dated 8.2.1996 passed by Additional District and Sessions Judge / Special Judge (E.C. Act), Budaun in S.T. No. 121 of 1991 (State vs. Vikar Ahmad) under Sections 307 IPC and 25 Arms Act, Police Station - Kotwali, District - Budaun.
From perusal of the report of Chief Judicial Magistrate, Budaun dated 10.10.2019, it transpires that the sole appellants- Viqar Ahamad has died.
In view of the above stated fact that the sole accused / appellant has since expired during course of the pendency of this appeal, this criminal appeal stands abated.
Consequently, this criminal appeal is dismissed as abated on account the death of the accused-appellant.
The present criminal appeal is accordingly dismissed as abated.
