1. In furtherance of the yesterday's order i.e. order dated 27.3.2012 today two affidavits are filed. One affidavit is by the petitioner - student duly signed by the petitioner - student and another by his father and the said affidavits have been served on the learned advocate for the respondent institute and they are found satisfactory and acceptable.
Therefore, below mentioned order is passed:-
(i) The petitioner may be allowed to appear in the ensuing examination.
(ii) For the second year of the course the petitioner - student, as per the undertaking in the affidavits, on his own volition shall leave the respondent's institute and seek admission in any other institute and shall not insist to continue in the respondent institute.
(iii) The respondent institute will make arrangement for conducting practical test of the petitioner - student and shall also permit him to appear and take the written tests of all subjects for first year course, provided all other conditions e.g. attendance etc. are fulfilled.
(iv) The petitioner - student will leave respondent's institute voluntarily and will not insist to prosecute further studies in the said institute.
(v) The petitioner- student will strictly follow the Rules and Regulations of the respondent institute related to examination failing which the relief granted by present order shall automatically stands vacated.
(vi) Present order will not create any other right, claim or privilege in favour of the petitioner and it is restricted only to the arrangement of allowing petitioner to appear in the ensuing examination.
With the aforesaid clarification the petition is disposed of.
