This application has been filed under Section 482 CrPC seeking a direction to the learned Additional Sessions Judge, Court No.7/Special Judge (Gangsters Act), Azamgarh to decide GT No.22 of 2012 (State Vs. Niranjan & Ors.) arising out of Case Crime No.369 of 2011, under Section 3(1) UP Gangsters Act, PS Bilariyaganj, District Azamgarh within some determinate period of time.
The applicant is an accused in the trial.
It is by now reputed for proposition of law that the accused has a right to speedy trial which is a facet of his fundamental right guaranteed under Article 21 of the Constitution. The trial relates to the year 2012. It is not known to this Court what is the precise pendency of cases before learned Special Judge (Gangster Act) according to their inter se seniority but so far as the accused is concerned he is certainly entitled to ask for an expeditious disposal.
Looking to the said facts, it is directed that the Trial Court will expedite proceedings of GT No.22 of 2012 (State Vs. Niranjan & Ors.) arising out of Case Crime No.369 of 2011, under Section 3(1) UP Gangsters Act, PS Bilariyaganj, District Azamgarh and endeavour to decide the same as expeditiously as possible preferably within a period of eight months next in accordance with law.
