Heard learned counsel for the parties.
Petitioner is working as Lekhpal in District Rampur. It is urged that between 9 June 2017 to 6 March 2019 petitioner has been transferred in various Tehsils of the District on five occasions. Petitioner, lastly, was transferred from Tehsil Sadar to Tehsil Shahbad vide order dated 6 March 2019. Petitioner has joined the place of posting and is performing his duties.
Grievance of the petitioner is that by the impugned order dated 5 April 2019 passed by the fourth respondent, Tehsildar Sadar, District Rampur, the official accommodation allotted to the petitioner at Tehsil Sadar has been cancelled on petitioner being posted at Shahbad.
Learned counsel for the petitioner submits that the son of the petitioner is student of class X, in case, the petitioner has to surrender the official accommodation, his family shall suffer irreparable loss and injury.
Learned Standing Counsel submits that the matter of the petitioner shall be considered and decided by the second respondent, Collector/District Magistrate, Rampur.
In regard thereto, without entering into the merits of the case, as well as, rival contentions raised by the respective parties, on consent, it is provided that the second respondent, Collector/District Magistrate, Rampur, shall consider and decide the grievance of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within two months from the date of filing of certified copy of this order along with the copy of the writ petition.
Till then, the effect and operation of the impugned order dated 5 April 2019 and consequential notice dated 13 April 2019 issued by the fourth respondent, Tehsildar Sadar, District Rampur, shall be kept in abeyance and shall abide by the decision to be taken by the second respondent.
With the aforementioned observations/directions, the writ petition stands disposed of.
