Heard Sri Ashutosh Pandey, learned counsel for the petitioners and Sri Irshad Hussain, learned AGA for the State and perused the impugned FIR as well as material brought on record.
This writ petition has been filed by the petitioners with a prayer to quash the first information report dated 07.05.2019 in Case Crime No. 0069 of 2019, under Section 498A, 304B I.P.C. and 3/4 D.P.Act, Police Station Kangrol, District Agra.
The affidavit, which has been sworn by Manohar Singh son of Santoshi, but in the affidavit where the particulars of the affidavit given appears to be defective and the stamp reporter has also not taken care of it and sent the matter to this Court.
Registrar General of this Court is directed to call for explanation from the stamp reporter as to how this petition sent to this Court without verifying the particulars of the affidavit filed in support of the petition.
Learned counsel for the petitioners states that he does not wish to press this petition and it may be dismissed as such with liberty to file afresh.
The writ petition is dismissed as not pressed with the aforesaid liberty.
Certified copy of the impugned FIR may be returned to learned counsel for the petitioners after retaining a photocopy of the said FIR.
Let a copy of this order be supplied to the Registrar General of this Court for communication and compliance and the report be submitted in our chamber on 05.07.2019.
