Heard Sri R.K. Chaturvedi, holding brief of Sri Kailash Singh Kushwaha, learned counsel for the appellant and Sri Dharmendra Vaish, learned counsel appearing for respondent nos.1 and 2.
This special appeal has been filed under Chapter VIII, Rule 5 of High Court Rules against the judgement and order dated 29.04.2019 passed by learned Single Judge in Writ-A No.5750 of 2019 (Vipin Kumar vs. Prathama Bank through its Chairman, Moradabad and 2 others).
Learned counsel for the appellant has vehemently argued various points in support of his contention and has submitted that the judgement and order passed by the learned Single Judge is illegal, perverse and against the law and the same cannot be sustained in law as the relevant material has not been considered.
Learned counsel for the appellant raised the argument, which he has already raised before the learned Single Judge as well as before this Court.
We have examined the judgement and order passed by the learned Single Judge in depth and we have also perused the findings recorded by the learned Single Judge and we are in full agreement with the same. The points raised by the learned counsel for the appellant is not substantiated under law and moreover no illegality could be pointed out by the learned counsel for the appellant in the judgement and order of the learned Single Judge.
In view of the aforesaid, we do not find any error in the impugned judgement and order dated 29.04.2019 passed by the learned Single Judge.
The special appeal is devoid of merits and is, accordingly, dismissed.
