List has been revised. No one appears for the petitioners. However, the Court has perused the records.
The present writ petition has been filed against the order dated 9.9.2016 passed by the Board of Revenue, Circuit Court, Meerut accepting the claim of respondent No. 2 for mutation in the revenue records. The order is only for mutation in the revenue records and does not finally decide the title of the parties. The petitioners have a remedy to institute appropriate proceedings for declaration of their rights.
Apart from the above, there is laches of almost three years in filing the present writ petition and the Court does not find satisfactory the explanation for laches as given in paragraph Nos. 22, 23 and 24 to the writ petition.
For the aforesaid reasons, it is not a fit case for interference by this Court under Article 226 of the Constitution of India.
The writ petition is dismissed.
