Heard Ms. Akanksha Mishra (AoR No. A/A - 0481/2017), holding brief of Shri Kshitij Shailendra, learned counsel for the petitioner, Shri Harsh Vardhan Gupta, for the respondent no. 3 and learned standing counsel for the State - respondent nos. 1 & 2.
The petitioner, in this writ petition, is seeking a direction to the respondents to take action on his complaint dated 04.04.2016.
According to the petitioner, he is a tenant of a Nazool land; what is the plot number; where is the land situate, nothing has been stated. It has not even been stated that the petitioner is a tenant of the land. The case of the petitioner is that the original lessee was only Sahu Saraswati Prasad Rastogi, whose lease expired in March, 1998 and that, the brother of the respondent no. 4, Mukesh Chandra, was never the lessee. Mukesh Chandra is not a party to the writ petition.
We do not even know as to what is the connection between Mukesh Chandra with the property in question or his connection with Sahu Saraswati Prasad Rastogi. We find that the writ petition has been filed with several deficiencies.
Learned counsel for the petitioner prays that the petitioner may be permitted to withdraw the writ petition with liberty to file a fresh writ petition with complete details and facts.
The writ petition is dismissed as withdrawn with the aforesaid liberty.
