Sri Ajay Kumar Pandey, learned counsel has entered in appearance on behalf of respondent no. 4.
Sri Ramesh Chandra Dwivedi, learned counsel for the petitioners, contends that the exercise of ascertaining the genuine members of the society as contemplated under Section 4-B of the Societies Registration Act, 1860, has not been undertaken till date.
Sri Arun Kumar Pandey, learned counsel for the respondent no. 4, does not contest the aforesaid facts.
Both the parties agree that the controversy should be decided by the Assistant Registrar, Firms, Societies and Chits, Gorakhpur.
Matter is remitted to respondent no. 6, Assistant Registrar, Firms, Societies and Chits, Gorakhpur. The respondent no. 6 shall undertake the exercise to decide the issue of membership of the society in adherence to the procedure prescribed under Section 4-B of the Societies Registration Act, 1860. The exercise shall be completed within a period of four months after giving opportunity of hearing to all concerned parties.
The writ petition is disposed of.
