A.M.Shaffique, J Petitioner, which is a service provider of a telecommunication tower has approached this court seeking police protection. 2. According to them they are putting up some additional equipments in an existing tower. This was obstructed by the party respondents and though the petitioner has approached police for necessary protection they have not taken any action, is the complaint of the petitioner.
3. Counter affidavit was filed inter alia stating that the idea of the petitioner is to put up a new tower. However, they are causing no physical obstruction.
4. Learned counsel for the petitioner submits that they are only putting up some additional equipments and no new construction is being made for the said purpose.
5. In the said circumstances, we are of the view that party WP(C).No.29842/14 2 respondents cannot obstruct any activity being done by them. This writ petition is disposed of directing the second respondent to ensure that no obstruction is created by the party respondent or their men in the matter relating to putting up of additional equipments in the existing tower of the petitioner.
